dose anyone know how the p40 with the merlin motor fared against the mustang 109 etc did any body make ace in that model

The Merlin powered models were the F L. A number of pilots in North Africa, particularly in the 325th FG became aces while flying them. In the Pacific, Merlin models saw combat with several 13th AF squadrons. Robert Westbrook of the 44th FS became an ace while flying the P-40F and later the Allison powered P-40M.
