The Kafka Trap!
A Kafka trap is a logical fallacy and rhetorical tactic where an accusation of wrongdoing is made, and any denial or defense by the accused is used as proof of their guilt. It creates a circular "heads I win, tails you lose" scenario from which it is logically impossible to escape.
Origin of the Term
The term was coined by American programmer and author Eric S. Raymond in 2010. It takes its name from Franz Kafka's 1925 novel, The Trial. In the book, the protagonist is arrested for an unspecified crime and finds himself trapped in an absurd, nightmarish legal system where every attempt to defend himself or prove his innocence is twisted by authorities into an admission of guilt.
